Terms of Use
These Terms of Use (“Terms”) govern your use of the GuardVPN – First Protection application (the “App”) and any related services provided under the domain guardvpn-protector.com. By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please do not install or use the App.

Eligibility and Account Responsibility
You must be legally capable of entering into a binding contract in your jurisdiction in order to use the App. By using the App, you confirm that you meet this requirement.
The App may rely on your Apple ID or on anonymous identifiers generated by the system. You are responsible for maintaining the security of your device and for any activity that occurs under your Apple ID when using the App.

VPN Service Description
GuardVPN – First Protection provides a virtual private network (VPN) service that routes your internet traffic through remote servers. The exact functionality and list of available locations may change over time as we update or improve the service.
While the VPN can enhance your privacy and security, no technology can guarantee absolute protection. You are responsible for using the App in a lawful and responsible manner, and for understanding the risks inherent to internet communication.

Acceptable Use
You agree not to use the App or VPN service to:
- Violate any applicable local, national, or international law or regulation.
- Transmit, store, or share content that is illegal, harmful, infringing, or abusive.
- Interfere with or disrupt networks, services, or devices of other users or third parties.
- Attempt to gain unauthorized access to systems or data.
We reserve the right, where legally permissible, to take reasonable measures to protect our infrastructure and other users of the service, which may include restricting access in cases of abuse or misuse.

Subscriptions, Trials, and Billing
Certain features of GuardVPN – First Protection are available via auto‑renewable subscriptions or other in‑app purchases. The pricing, duration, and conditions of each subscription option are clearly shown in the App before you confirm any purchase.
Payment will be charged to your Apple ID account at the time of purchase. Your subscription will automatically renew at the end of each billing period unless you turn off auto‑renewal at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription in your account settings on your device after the purchase is made. Any unused portion of a free trial period, if offered, may be forfeited when you purchase a subscription.

Refunds and Purchase Review
Refunds for subscriptions and in‑app purchases are handled by Apple according to the App Store's policies. We do not process payments or refunds directly.
When an end user requests a refund for an in‑app purchase, Apple may ask us for additional information to help evaluate the request. In such cases, we may provide Apple with non‑sensitive usage details related to that purchase, such as approximate time spent in the App, an anonymized internal identifier, the total amount charged, and the total amount previously refunded. This information is shared solely for the purpose of helping Apple review the refund request and is not used to profile users or for marketing.

Intellectual Property
All rights, title, and interest in and to the App, including but not limited to software, design, text, graphics, logos, and other content, are owned by the developer or its licensors. You are granted a limited, non‑exclusive, non‑transferable license to use the App on devices that you own or control, in accordance with these Terms and the App Store rules.
You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App, except to the extent that such restrictions are prohibited by law.

Third‑Party Services
The App may interact with or rely on third‑party services, such as Apple's payment and authentication systems, or infrastructure providers that operate VPN servers. Those third parties may have their own terms of use and privacy policies. Your use of such services is subject to their respective conditions.
We are not responsible for the content, availability, or practices of third‑party services, but we aim to work only with reputable providers that take security and privacy seriously.

Service Availability and Changes
We strive to keep GuardVPN – First Protection available and up to date, but we cannot guarantee uninterrupted or error‑free operation. The service may be temporarily unavailable due to maintenance, technical issues, or factors beyond our control.
We may modify, suspend, or discontinue certain features or server locations at any time, with or without notice, provided that such changes remain consistent with applicable laws and platform rules. Where feasible, we will aim to make changes in a way that minimizes disruption for active users.

Disclaimer of Warranties
The App and VPN service are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
We do not warrant that the service will meet your requirements, achieve specific results, or be free from interruptions, delays, or security vulnerabilities. Your use of the App is at your own risk.

Limitation of Liability
To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the App or these Terms.
In any event, our total aggregate liability for all claims relating to the App shall be limited to the amount you have paid for access to the service during the twelve (12) months immediately preceding the event giving rise to the claim, or to the smallest amount permitted by applicable law if a higher limitation cannot be enforced.

Indemnification
You agree to indemnify and hold harmless the developer, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your infringement of any third‑party rights.

Changes to These Terms
We may update these Terms from time to time, for example when we introduce new features or to comply with changes in applicable laws or platform requirements. When we make material updates, we will revise the date at the top of this page and may display a notice within the App.
By continuing to use GuardVPN – First Protection after the updated Terms become effective, you agree to be bound by the revised version. If you do not agree, you should stop using the App and cancel any active subscription.

Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the developer, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless mandatory law provides otherwise.
